Effective as set out in Article 14, but no earlier than publication of this version as the active Policy in the Eventringo service
This translation is provided for convenience. The Czech version is the governing text.
This Refund Policy (the "Policy") explains the Consumer's statutory right of withdrawal, the voluntary refund for an unused Event Pass, remedies for a defective digital service, and other payment issues. It supplements the Eventringo Terms of Service. The Consumer's mandatory statutory rights always prevail.
1. Provider and contact
Eventringo is operated by:
- Filip Lněnička
- ID number: 22028081
- place of business: Trávníčkova 465/3, Zábrdovice, 614 00 Brno, Czech Republic
- email: support@eventringo.com
- phone: +420 777 867 380
Specialized online features are available after logging into the Refunds page in your Creator account. A clear legal notice can always be sent by e-mail or post; the use of the online form is not a condition for the exercise of a legal right.
2. What the Policy applies to
Eventringo provides a time-limited digital service for creating and managing private Events, especially photo bingo, gallery, moderation, slideshow, questions and export. A paid Event Pass is a one-time service order for one Event with a validity period of 365 days. This is not a ticket to the Event or an auto-renewable subscription.
This Policy applies to:
- paid Event Passes;
- paid Event Pass upgrades;
- free Event Passes to the extent of a service complaint, not a monetary refund of the price that was not paid;
- Consumers and other customers, while legal consumer rights belong only to persons who meet the legal definition of Consumer.
The first use of the Event Pass occurs by successfully saving the first original photo for the assigned Event. Simply purchasing, making available, assigning or setting up an Event Pass, creating an Event, editing bingo fields, setting up a gallery or slideshow, or connecting participants is not in itself First Use.
3. Four different procedures
The Refunds page separates four situations:
- legal withdrawal from the contract within 14 days – for the Consumer who withdraws from the contract concluded remotely;
- voluntary refund of unused Event Pass – Eventringo's above-standard automated option according to Article 5;
- digital service complaint – for a defective, unavailable or incorrectly provided Service;
- other payment problem – for example, a double, incorrect or unauthorized payment.
The non-appearance of an order in the list of voluntary refunds is not a rejection of withdrawal, complaint or other legal claim. The content of the request is decisive, not just the name of the chosen category.
4. Legal withdrawal of the Consumer within 14 days
The consumer can generally withdraw from a contract concluded at a distance without giving a reason within 14 days from the date of conclusion of the contract. To keep the deadline, it is enough to send a clear statement before it expires.
Withdrawals can be sent to:
- the "Withdraw from the contract" online function on the Refunds page in the Creator's account;
- by email to support@eventringo.com; or
- by mail to the address specified in Article 1.
The online function requires selection of the exact order followed by the "Confirm withdrawal from the contract" button. Eventringo records the exact statement, the order concerned, the identity of the signed-in Creator, and the date and time received, and sends an acknowledgement to the account email without undue delay. Acknowledgement of receipt is not itself a final decision on the request.
At the express request of the Consumer, Eventringo starts to provide the digital service before the expiry of the fourteen-day period. Merely making the Event Pass available, creating an Event or First Use does not automatically cancel the right to withdraw.
If the Consumer withdraws after provision of the Service began at the Consumer's express request, the Consumer may be required to pay a proportionate part of the agreed price for the performance actually provided before Eventringo was notified of the withdrawal. The proportionate amount is determined by comparing the scope and value of the performance already provided with the full agreed performance, taking account of the total agreed price and mandatory law. It will not automatically equal the full price merely because the Event Pass was technically made available, an Event was created, or a photo was stored. Eventringo will explain the calculation and its basis when handling the withdrawal.
The right to withdraw from the contract for the Service expires within the 14-day period only once the Service has been fully performed and all statutory conditions are met, including the Consumer's prior express request and prior acknowledgement that the right will be lost upon full performance. If the express request or required statutory information was not properly obtained, Eventringo will not seek a proportionate payment where the law does not permit one.
In the event of a valid withdrawal, Eventringo will return the funds received, after deducting any statutory pro rata payment, without undue delay, no later than 14 days after notification of withdrawal, by the same means of payment, unless the Consumer expressly agrees to another free procedure.
5. Voluntary refund of unused Event Pass
Eventringo offers an automated refund of unused paid Event Pass beyond the scope of the law. This option is separate from legal withdrawal and complaint and does not limit their conditions in any way.
An Event Pass will appear in the automatic list if the system verifies in particular that:
- the request is submitted within 14 days of successful payment confirmation;
- it is a paid Event Pass registered in the current Stripe environment;
- Event Pass is active and its First Use has not been recorded;
- no photos or saved media objects are registered for the assigned Event;
- no paid upgrade has been completed for the Event Pass;
- a voluntary refund has not already been issued for the same Event Pass;
- the order contains a verifiable Stripe Checkout and Payment Intent.
An unused Event Pass may be eligible even before being assigned to an Event. Merely configuring an Event or joining participants does not in itself invalidate eligibility. However, if there are stored media, First Use or completed upgrade, the automatic flow will not accept the order and the customer can use another corresponding category for individual assessment.
An automatic request will ask Stripe to refund the entire outstanding amount of that payment to the original payment method. The displayed amount is based on the amount actually registered with the order, not on the current list price.
A refund may be listed in Stripe as pending or requiring further action. In such a case, Eventringo will not delete the Event or the Event Pass until Stripe reports a successful refund. If Stripe rejects, cancels or marks a refund as unsuccessful, the data is not automatically deleted for this reason and the customer can contact support.
After Stripe confirms a successful refund:
- the refunded Event Pass will be deactivated;
- the assigned Event and its settings are permanently removed from the active Eventringo systems;
- related managed media is removed or placed in a secure technical cleanup queue;
- no replacement Event Pass is restored or created.
Before confirming a voluntary refund, the Creator must acknowledge the permanent removal of the assigned Event. Data that Eventringo must retain for accounting, contractual, security or legal evidence may remain separately retained for the period specified in the Privacy Policy. Backups are overwritten in regular secure cycles.
Eventringo may suspend the automatic flow and manually review the matter in the event of a payment information discrepancy, suspected fraud, or technical error. This is without prejudice to any statutory right.
6. Event Pass upgrades
A paid upgrade is a separate contract and a separate payment transaction. Its legal withdrawal or complaint is considered separately according to the specific upgrade order.
A completed upgrade removes the entire Event Pass from the automated process in Article 5 because a simple automated refund of the original payment may not correctly settle the later order. This is not a rejection of a statutory claim; the Consumer may use the withdrawal or complaint form and select the exact upgrade order.
Unless expressly agreed otherwise, an upgrade does not extend the original Event Pass validity period. A new upgrade order does not restart the voluntary 14-day period for the original Event Pass.
7. Digital service complaint
The consumer may complain in particular about a Service that has not been made available, is not in accordance with the contract, lacks an agreed function, is unreasonably unavailable or has not been updated to the extent required by law.
Complaints can be sent using the authenticated form on the Refunds page, by email or by post. It is advisable to state the specific order, describe the defect, explain when and how it appears and its impact, and identify the requested remedy. Missing information does not prevent processing if the complaint can still be assessed.
Eventringo will acknowledge receipt of the complaint, including its content and date, without undue delay. Eventringo will handle a complaint concerning the digital service and inform the Consumer of the outcome without undue delay and within a reasonable time, taking account of the nature of the Service, the purpose for which the Consumer requested it, and any necessary cooperation. A fixed shorter or maximum period prescribed by mandatory law applies where relevant.
According to the legal conditions, the Consumer can request the Service to be brought into line, a reasonable discount or the termination of the contract with the return of the corresponding price. Eventringo may refuse compliance only if it is impossible or would require disproportionate costs with regard to the importance of the defect and the value of the performance. The statutory order and terms of remedy take precedence over this Policy.
A problem caused solely by an incompatible device, an unsupported browser or the customer's connection may be taken into account in the assessment if Eventringo has fulfilled its information and cooperation obligations in advance. This rule is not a blanket exclusion of liability for defects in the Service.
8. Another payment problem
For a duplicate, incorrect, unknown, unauthorized or otherwise disputed payment, please use the "Other Payment Issue" form or email support@eventringo.com. Include the specific order and description of the problem; do not send full card number, CVC or access details.
If you suspect unauthorized use of a payment method, contact your bank or card issuer immediately. Eventringo may require reasonable verification of identity and account ownership, but will never require a password or CVC.
Refunds of incorrectly charged amounts, double payment rectification and unauthorized transaction rights are governed by applicable law and the rules of the payment service provider. Initiating a chargeback does not relieve the customer of legal rights, but may affect the concurrent technical processing of the same amount.
9. Method and time of refund
Refunds are made through Stripe to the original payment method, unless otherwise required by law or the customer expressly agrees to a different procedure at no additional cost.
Eventringo does not issue a cash refund for a free Event Pass, promo code or discount that has not been paid for by the customer. No more than the actual paid and not yet refunded amount of the transaction in question is refunded; statutory discount, compensation or other remedy is not affected.
Eventringo will issue a statutory refund within the period required by law. After it is issued, additional time may be needed for the funds to reach the account depending on the original payment method, bank, card issuer, and Stripe. A pending refund status does not mean that the amount has already been credited.
Eventringo does not issue refunds using another payment method simply for faster processing if this would create a security, accounting or fraud risk.
10. Termination of Access, Export and Data
Upon valid withdrawal, termination of the contract or successful voluntary refund, Eventringo may disable the affected Event Pass and prevent its further use.
If required by law, Eventringo shall, at the Consumer's request, make available, free of charge and within a reasonable time, the content provided or created by the Consumer through the Service in a commonly used machine-readable format. Statutory exceptions, the protection of the rights of others and the technical severability of the content are not affected by this.
For a voluntary automatic refund associated with the permanent deletion of the Event, the Creator must perform the necessary export before confirmation. Statutory withdrawal or complaint cannot be made conditional on waiving the rights granted to the customer by law.
11. Entrepreneurs and customers outside the Czech Republic
The voluntary program according to Article 5 can also be offered to a customer who is not a Consumer, if they meet its technical conditions. Statutory consumer rights are not transferred to entrepreneurs just because the form is technically available.
If the Consumer is protected by mandatory law in the country of the Consumer's habitual residence in the European Union or another country, this Policy does not limit that mandatory protection. Choosing CZK, EUR or USD does not by itself determine the customer's residence, tax status or applicable law.
12. Abuse and Fraud
Eventringo may reasonably verify the request and suspend automatic processing upon reasonable suspicion of fraud, misuse of refunds, identity mismatch or attempt to refund an amount that has already been refunded. The inspection must be reasonable and must not arbitrarily shorten the statutory period or make the exercise of consumer rights impossible.
Refusal of a voluntary refund because the conditions in Article 5 are not met does not automatically constitute a denial of statutory withdrawal, a complaint, an incorrect-payment claim or a claim for damages.
13. Out-of-court settlement of consumer disputes
The Czech Trade Inspection Authority is responsible for out-of-court settlement of consumer disputes:
- Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Prague 2
- e-mail: adr@coi.gov.cz
- website: https://coi.gov.cz/informace-o-adr/
A Consumer may use ADR after an unsuccessful attempt to resolve the dispute directly with Eventringo. The application must be submitted no later than one year after the Consumer first asserted with Eventringo the right that is the subject of the dispute. This information does not affect the right to apply to a competent court.
14. Policy Changes
Eventringo may change this Policy, in particular because of changes in law, payment processes, or Service features. A particular order is governed by the version stored when the contract was concluded and, for a request, by the rule applicable when the request is made, unless a more favorable or mandatory regime applies by law. A new version will not be applied retroactively without express agreement so as to impair an existing right or the terms of a previously purchased Event Pass.
Version 2.0 applies to orders placed after its publication and to an earlier contractual relationship only if the customer expressly accepts it or a particular change is validly made under the existing contract and applicable law. Acceptance of the new Terms of Service may also incorporate this Policy; silence or merely continuing to use the Service does not constitute express acceptance. A change to the voluntary program does not retroactively restrict a statutory claim already made.
